In our Daily Update from April 23rd and 24.04th, we reported on a passage in the Indian Ministry of Interior's order and the resulting “scaremongering” in Indian newspapers (such as “Imprisonment for managers if an employee falls ill”).

Our interpretation at the time, that this passage does not refer to companies that demonstrably fulfill their duty of care to comply with appropriate hygiene, distance rules, etc., has now been fully confirmed by the Indian government and warned against false reports.

The situation in India is similar to that in most other countries in the world: the legislature simply wants to “force” companies to carefully address the issue of “occupational safety under Corona”.

Therefore: Prepare for the resumption of your business activities with, among other things detailed concept for the concrete implementation of the hygiene and distance rules as well as to the technical control measures before - for details see here.

A corresponding “certificate” should ideally certify that the measures you have introduced in your company comply with the requirements. This reduces the risk of having to justify yourself to the authorities at a later date. Unfortunately, in India it does happen that such opportunities are abused to put pressure on companies after many months by “talking” them into alleged non-compliances.
