Shareholder meetings are temporarily possible via video conference!
Due to travel restrictions, shareholders' meetings (so-called “general meetings”), which normally have to take place physically at the Indian location of a company's registered office, can now temporarily be held as a video conference. It is important to ensure that certain requirements are adhered to, including a recording of sound and images.
Validity of digital delivery
Already last week the Ministry of Corporate Affairs (MCA) the holding of shareholder meetings in digital form, via recorded video conferencebelieves. In recent days the question has arisen as to how invitations to a meeting should be handled, as they previously had to be sent by post. Now the MCA has allowed invitations tooe-mails are legally valid, as are (at Listed Companies) also publish the dates and access options on the company websitee.
Update from May 7.5th: It has now been clarified that this also applies to annual general meetings (“AGMs”).
